Witness for the plaintiff: a retired sergeant of the Marsh Regiments

A retired sergeant of the Marsh Regiments was sworn and examined.

Q. You know both parties? A. I have known them 20 years. Q. And the matter in dispute? A. I understood there was a quarrel about a boundary between two farms. Everyone understood that. Q. What did you see yourself? A. I was at Hollstadt that morning, on my own business, and saw what the whole street saw.

Cross-examined. Q. You are a friend of the plaintiff? A. I am a friend of both. Q. You dined with the plaintiff last week? A. I dined at the inn and the plaintiff was there. The Judge: That will do.

Witness for the defence: the landlord of the inn

The landlord of the inn was called for the defence and sworn.

Q. You were with the accused that day? A. All day. Q. From when? A. From before first light until dark. Q. And he did nothing of the kind alleged? A. Nothing that I saw, and I saw all he did.

Cross-examined. Q. You are a friend of the plaintiff? A. I am a friend of both. Q. You dined with the plaintiff last week? A. I dined at the inn and the plaintiff was there. The Judge: That will do.

Witness for the defence: a constable of the town watch

A constable of the town watch was called by the defence.

Q. You were with the accused that day? A. All day. Q. From when? A. From shortly before the evening bell until dark. Q. And he did nothing of the kind alleged? A. Nothing that I saw, and I saw all he did.

Cross-examined. Q. You did not see the document? A. I saw a paper. Q. You could not read it from where you stood? A. I could not, and I did not try.

Submissions

Counsel for the plaintiff submitted that the claim was made out. Counsel for the defendant submitted that it was not, and cited the authorities. The court retired.
