Proceedings
The court sat at 10.00. The Clerk called the case. Counsel announced their appearances for the record.
The pleadings were read: smoke from a tannery. The defendant answered by a general denial. Counsel for the plaintiff opened. The matter was one of fact and the court would decide it on the evidence.
Witness for the plaintiff: the landlord of the inn
The landlord of the inn was sworn and examined.
Q. Tell the court what you know. A. It was talked of at the market for a month before it came to court. I was in my usual place, at about half past 7, and heard it before I saw it. Q. Nothing more? A. Nothing that I saw myself.
Cross-examined. Q. You are a friend of the plaintiff? A. I am a friend of both. Q. You dined with the plaintiff last week? A. I dined at the inn and the plaintiff was there. The Judge: That will do.
Witness for the plaintiff: a constable of the town watch
A constable of the town watch, sworn. Examined by counsel for the plaintiff.
Q. You know both parties? A. I have known them 18 years. Q. And the matter in dispute? A. I was told of it by the sexton. I did not enquire further. Q. What did you see yourself? A. I was passing, shortly before the evening bell. I did not stop long.
Cross-examined. Q. You did not see the document? A. I saw a paper. Q. You could not read it from where you stood? A. I could not, and I did not try.
Witness for the defence: a reed-cutter
A reed-cutter, sworn, examined by counsel for the defence.
Q. You know the defendant's side of the matter? A. I know both sides and I have kept out of it until today.
Cross-examined. Q. You did not see the document? A. I saw a paper. Q. You could not read it from where you stood? A. I could not, and I did not try.
Submissions
Counsel addressed the court. The judge asked for the deeds, read them at the bench, and retired.
