Proceedings

Q. You know both parties? A. I have known them 6 years. Q. And the matter in dispute? A. It was talked of at the market for a month before it came to court. Q. What did you see yourself? A. I was in my usual place, a little after 9 in the morning, and heard it before I saw it.

Cross-examined. Q. You did not see the document? A. I saw a paper. Q. You could not read it from where you stood? A. I could not, and I did not try.

Witness for the plaintiff: a constable of the town watch

A constable of the town watch took the oath.

Q. Tell the court what you know. A. I was told of it by a schoolmaster who happened to be passing. I did not enquire further. I was at my work. I heard a noise and went to the door. Q. Nothing more? A. Nothing that I saw myself.

Cross-examined. Q. How far is it from your door to the place? A. 247 paces. Q. You have measured it? A. My boy has. Q. For this case? A. For his own reasons.

Submissions

Counsel for the plaintiff submitted that the claim was made out. Counsel for the defendant submitted that it was not, and cited the authorities. The court retired.

Judgment

The court returned at the rising of the court. The judgment was read and is entered in the Law Reports as follows.

Concerning an unpaid debt of 1933 marka. Ruling: dismissed.

Costs

Costs to follow the event. The court rose at the rising of the court.
